1. INTRODUCTION

These Terms and Conditions ("Terms") govern all courier, freight, and logistics services provided by B2Y Shipping ("Company", "we", "us", or "our"). By using our services, the customer ("you" or "Customer") agrees to be legally bound by these Terms, the Privacy Policy, and any applicable service-specific conditions.

2. SERVICES OFFERED

2.1 Air Freight

Air freight services are designed for time-sensitive shipments transported via commercial airlines.

Estimated Delivery Timeframe: 3–5 business days after arrival in Jamaica, excluding customs processing.

2.2 Sea Freight

Sea freight is suitable for bulk, oversized, or non-urgent cargo transported via ocean vessels.

Estimated Delivery Timeframe: 14–30 business days after vessel arrival, subject to port and customs clearance.

2.3 Ground Transportation

Local transportation for pickups and deliveries within St. Mary, Jamaica.

Estimated Delivery Timeframe: 1–3 business days after shipment processing.

Additional charges apply for special services.

3. CUSTOMER RESPONSIBILITIES

3.1 Packaging Standards

Customers must ensure all shipments are adequately packed, sealed, and labeled to withstand normal handling and transportation conditions.

3.2 Documentation and Declarations

Customers are solely responsible for providing accurate invoices, customs declarations, permits, and supporting documentation as required by the Jamaica Customs Agency and other regulatory bodies.

3.3 Prohibited and Restricted Items

Customers warrant that shipments do not contain prohibited or restricted items listed in Section 9 of these Terms.

4. COMPANY RESPONSIBILITIES

B2Y Shipping shall exercise reasonable care in handling shipments but does not guarantee delivery dates or times. All delivery timelines are estimates.

5. PRICING AND PAYMENT TERMS

5.1 Pricing Method

Charges are calculated based on the greater of:

  • Actual weight, or

  • Volumetric (dimensional) weight

5.2 Additional Fees

Additional charges may include:

  • Processing fees

  • Handling charges

  • Customs inspection or brokerage fees

  • Storage fees

  • Special service charges

5.3 Payment Terms

  • Upfront payment is mandatory before release or delivery

  • Approved business customers may receive Net 30 credit terms at the Company’s discretion

Non-payment may result in shipment holds, storage charges, or account suspension.

6. LIABILITY AND INSURANCE

6.1 Strict Liability Limitation

B2Y Shipping’s maximum liability is strictly limited to the lesser of:

  • JMD $5,000 per shipment, or

  • The actual proven value of the lost or damaged goods

6.2 Exclusions of Liability

The Company shall not be liable for:

  • Indirect, incidental, or consequential losses

  • Delays caused by customs, weather, government actions, or force majeure

  • Damage arising from improper packaging or undisclosed contents

6.3 Insurance

Insurance coverage is not automatic. Customers are encouraged to request additional insurance prior to shipment acceptance.

7. CLAIMS PROCEDURE

All damage or loss claims must:

  • Be submitted in writing within 7 calendar days of delivery

  • Include supporting documentation and photographs

Claims submitted outside this timeframe will not be honored.

8. DELIVERY TERMS AND STORAGE

8.1 Failed Delivery Attempts

If delivery cannot be completed due to customer fault, re-delivery fees apply.

8.2 Storage Fees

Shipments uncollected within 5 business days of arrival are subject to daily storage fees and may be disposed of after 30 days.

9. PROHIBITED AND RESTRICTED ITEMS (CUSTOMS BLOCKED LIST)

In accordance with Jamaican law, B2Y Shipping does not accept:

  • Firearms, ammunition, explosives

  • Illegal drugs and controlled substances

  • Hazardous, flammable, or radioactive materials

  • Counterfeit or pirated goods

  • Cash, precious metals, or gemstones

  • Pornographic or offensive material

  • Perishable food items without prior approval

Undeclared prohibited items may be surrendered to authorities without compensation.

10. FORCE MAJEURE

B2Y Shipping is not liable for failure or delay caused by events beyond its reasonable control, including natural disasters, labor disputes, customs delays, or government actions.

11. DISPUTE RESOLUTION

11.1 Complaints

All complaints must be submitted in writing to [email protected].

11.2 Governing Law

These Terms are governed by the laws of Jamaica.

11.3 Jurisdiction

The courts of Jamaica shall have exclusive jurisdiction.

12. PRIVACY AND DATA PROTECTION

B2Y Shipping complies with the Data Protection Act, 2020 (Jamaica). Customer data is collected solely for service delivery, billing, and regulatory compliance and is not sold or shared except where legally required.

13. MODIFICATION OF TERMS

The Company reserves the right to amend these Terms at any time. Updates take effect upon publication on the Company’s website.

14. TERMINATION OF SERVICES

B2Y Shipping may suspend or terminate services for:

  • Breach of these Terms

  • Non-payment

  • Illegal or abusive conduct

Outstanding balances remain payable upon termination.

15. REFUND POLICY

15.1 Eligibility

Refunds are issued only where services were paid for but not rendered due to Company error.

15.2 Exclusions

No refunds for customs delays, force majeure events, or customer-provided errors.

15.3 Processing Time

Approved refunds are processed within 14 business days via the original payment method.

16. ACCEPTANCE OF TERMS

Use of B2Y Shipping’s services constitutes full acceptance of these Terms and Conditions.
